En particulier, le Bureau de Presse a indiqu\u00e9 que<strong> la mention \u00ab\u00a0<em>d\u2019un montant \u00e9gal \u00e0 un mois du dernier salaire de r\u00e9f\u00e9rence pour le calcul de l&rsquo;indemnit\u00e9 de d\u00e9part pour chaque ann\u00e9e de service<\/em>\u00a0\u00bb a \u00e9t\u00e9 d\u00e9clar\u00e9e inconstitutionnelle.<\/strong> Cela parce que, selon le Conseil Constitutionnel, cette mention fixe un <strong>crit\u00e8re rigide et automatique, li\u00e9 uniquement \u00e0 l&rsquo;\u00e9l\u00e9ment d&rsquo;anciennet\u00e9 de service<\/strong>. Le Conseil Constitutionnel retoque ainsi de nouveau le Jobs Act. Il s\u2019\u00e9tait en effet d\u00e9j\u00e0 exprim\u00e9 en 2018, en d\u00e9clarant infond\u00e9 l&rsquo;art. 3, alin\u00e9a 1, du d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015, de fa\u00e7on limit\u00e9e au crit\u00e8re de fixation de l&rsquo;indemnit\u00e9 \u00e0 verser en cas de licenciement sans juste motif et de licenciement \u00e9conomique, fond\u00e9 automatiquement et uniquement sur l&rsquo;anciennet\u00e9 de service.
