{"id":11483,"date":"2021-06-09T15:01:18","date_gmt":"2021-06-09T13:01:18","guid":{"rendered":"https:\/\/www.delucapartners.it\/news-fr\/licenziamento-legittimo-se-la-sindrome-depressiva-post-infortunio-e-inesistente-e-si-svolge-altra-attivita-lavorativa\/"},"modified":"2021-06-18T15:14:25","modified_gmt":"2021-06-18T13:14:25","slug":"licenciement-legitime-si-le-syndrome-depressif-post-accidentel-est-inexistant-et-que-lon-exerce-une-autre-activite-de-travail","status":"publish","type":"post","link":"https:\/\/testing.delucapartners.it\/fr\/news-fr\/publications-2-fr\/licenciement-legitime-si-le-syndrome-depressif-post-accidentel-est-inexistant-et-que-lon-exerce-une-autre-activite-de-travail\/","title":{"rendered":"Licenciement l\u00e9gitime si le syndrome d\u00e9pressif post-accidentel est inexistant et que l&rsquo;on exerce une autre activit\u00e9 de travail (Il Quotidiano del lavoro de Il Sole 24 Ore, 9 Juin 2021 \u2013 Enrico De Luca, Debhora Scarano)"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Par l&rsquo;arr\u00eat 15465 du 3 juin 2021, la Cour de cassation, section du travail, s&rsquo;est \u00e0 nouveau prononc\u00e9e sur les particularit\u00e9s du licenciement pour juste cause impos\u00e9 au salari\u00e9 qui effectue un autre travail pendant son arr\u00eat maladie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En particulier, un licenciement disciplinaire a \u00e9t\u00e9 prononc\u00e9 \u00e0 l&rsquo;encontre d&rsquo;un fonctionnaire qui, \u00e0 la suite d&rsquo;un accident du travail, a produit des certificats m\u00e9dicaux relatifs \u00e0 un pr\u00e9tendu syndrome anxio-d\u00e9pressif, a obtenu un cong\u00e9 de maladie au cours duquel, toutefois, il a \u00e9t\u00e9 film\u00e9 par une agence de d\u00e9tectives alors qu&rsquo;il travaillait dans l&rsquo;entreprise commerciale de sa fille, d\u00e9montrant ainsi qu&rsquo;il n&rsquo;\u00e9tait atteint d&rsquo;aucun trouble, ni physique ni psychologique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suite au recours contre le licenciement, il est apparu, dans le cadre de la proc\u00e9dure de premi\u00e8re instance, que le travail effectu\u00e9 dans cet \u00e9tablissement n&rsquo;\u00e9tait pas occasionnel mais continu et caract\u00e9ris\u00e9 par un engagement non moins lourd que celui requis pour exercer les fonctions d&#8217;employ\u00e9 subalterne \u00e0 l&rsquo;Agence du patrimoine de l&rsquo;\u00c9tat. En appel, il a, par ailleurs, \u00e9t\u00e9 constat\u00e9 que les certificats m\u00e9dicaux d\u00e9livr\u00e9s concernant l&rsquo;existence et la nature des pathologies qui avaient affect\u00e9 le salari\u00e9 apr\u00e8s l&rsquo;accident n&rsquo;\u00e9taient pas coh\u00e9rents entre eux. La Cour d&rsquo;appel a donc jug\u00e9 que le syndrome anxio-d\u00e9pressif n&rsquo;existait pas et que, m\u00eame s&rsquo;il existait de mani\u00e8re latente, il ne pouvait \u00eatre li\u00e9 \u00e0 l&rsquo;accident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le Tribunal de premi\u00e8re instance et le Tribunal territorial avaient ainsi rejet\u00e9 le recours du salari\u00e9, ent\u00e9rinant la th\u00e8se de la l\u00e9gitimit\u00e9 de la rupture du contrat par l&#8217;employeur.
